18 U.S.C. § 2257 Compliance Statement

All visual depictions displayed on FansXO (fansxo.app and its subdomains, the “Site”) are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. § 75 because either (a) they do not contain depictions of conduct as specifically listed in 18 U.S.C. § 2256(2)(A) parts (i) through (iv), or (b) the visual depictions were produced before July 3, 1995.

For any visual depictions not exempt under the foregoing, FansXO is not the “producer” (as that term is defined in 28 C.F.R. § 75.1(c)) of the visual depictions appearing on the Site. FansXO is an interactive computer service that hosts user-generated content. Pursuant to 47 U.S.C. § 230(c), FansXO is not the publisher or speaker of any information provided by users of the Site. The original records required by 18 U.S.C. § 2257 and 28 C.F.R. § 75 for material depicting a performer in sexually explicit conduct are kept by the individual producer of that content.

FansXO nevertheless requires every creator who uploads, posts, or transmits sexually explicit content through the Site to:

1. Verify their identity and age through a third-party identity verification provider (currently Yoti Limited) before posting any explicit content;
2. Submit a signed model release and a copy of a valid government-issued photo identification for each performer appearing in the content;
3. Affirm under penalty of perjury that every performer in the content was at least 18 years of age at the time of recording, and that the creator has the legal right to upload the content; and
4. Maintain primary 18 U.S.C. § 2257 records for the content they produce and certify that those records will be made available for inspection upon lawful request.

Zero Tolerance for Child Sexual Abuse Material (CSAM)

FansXO has a zero-tolerance policy for any material that sexualizes a minor, including computer-generated, drawn, or AI-generated depictions. We use automated and human review to detect such material, terminate the offending account, preserve the content and all associated metadata for at least 90 days, and report the incident to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by 18 U.S.C. § 2258A.
