18 U.S.C. § 2257 Compliance Statement

Overview

This statement describes the federal record-keeping framework that applies to sexually explicit visual depictions on FansXO (fansxo.app and its subdomains, the “Site”) and outlines the compliance obligations of FansXO and the creators who post content. It is provided for informational purposes and does not constitute legal advice.

Creator Obligations

Creators who upload sexually explicit content to the Site are responsible for compliance with 18 U.S.C. § 2257 and 28 C.F.R. Part 75, including maintenance of all required primary records for content they produce. By uploading content, each creator represents and warrants that:

1. They have completed FansXO's identity verification process through our third-party identity verification provider (currently Veriff) before posting any explicit content.
2. Every individual depicted in the content was at least 18 years of age at the time the content was produced.
3. They hold all rights necessary to upload and distribute the content, including written model releases and informed consent from every individual depicted.
4. They will retain primary 18 U.S.C. § 2257 records for content they produce and make those records available for inspection upon lawful request.
5. They will not upload content depicting any minor, content produced without the verified consent of every individual depicted, or content they do not have the legal right to distribute.

Platform Role and Compliance Procedures

FansXO hosts content uploaded by independent creators and is not the original producer of that content. FansXO maintains verification and compliance procedures designed to support — but not substitute for — each creator's own record-keeping obligations under 18 U.S.C. § 2257. These procedures include:

• Identity and age verification of every creator through a third-party identity verification provider before posting privileges are granted.
• Retention of verification records associated with each creator account.
• Internal logging of content uploads, including the responsible creator, timestamp, and creator attestations of consent and rights to the content.
• Automated and human review of uploaded content for compliance with platform policies, including age verification and content rules.

Designated Custodian of Records

For records FansXO maintains in connection with the verification and compliance procedures described above, the designated custodian is:

Records subject to inspection are available during regular business hours, Monday through Friday, 9:00 a.m. to 5:00 p.m. Central Time, by appointment. To schedule an inspection, contact records@fansxo.app.

Zero Tolerance for Child Sexual Abuse Material

FansXO has a zero-tolerance policy for any material that sexualizes a minor, including computer-generated, drawn, or AI-generated depictions. When such material is identified or reported, FansXO will:

• Suspend or terminate the offending account.
• Preserve relevant content, account information, and associated metadata to the extent required by applicable law and as practicable to support investigation.
• Report the matter to the National Center for Missing & Exploited Children (NCMEC) in accordance with 18 U.S.C. § 2258A.
• Cooperate with law enforcement and respond to lawful requests.

Copyright and Repeat Violator Policy

FansXO respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). Notices of claimed infringement must be sent to the designated DMCA agent at dmca@fansxo.app and must include the information required by 17 U.S.C. § 512(c)(3). In appropriate circumstances, FansXO terminates accounts of users determined to be repeat infringers of intellectual property rights or repeat violators of platform policies.
